1AAnp. Ngày 9/6, Quốc hội cho ý kiến lần 2 đối với dự án Luật Đất đai sửa đổi. Dự thảo Luật đã được chỉnh lý trên cơ sở tiếp thu, giải trình ý kiến đại biểu Quốc hội tại Kỳ họp thứ 4, hội nghị đại biểu Quốc hội hoạt động chuyên trách tháng 4/2023 và ý kiến nhân dân. Về kết quả lấy ý kiến nhân dân, Bộ trưởng Tài nguyên và Môi trường Đặng Quốc Khánh cho biết đã có hơn 12 triệu lượt ý kiến góp ý đối với dự thảo Luật Đất đai sửa đổi. Các nội dung được Nhân dân quan tâm góp ý tập trung vào bồi thường, hỗ trợ, tái định cư; giao đất, cho thuê đất, chuyển mục đích sử dụng đất; tài chính đất đai, giá đất; quy hoạch, kế hoạch sử dụng đất. Dự thảo Luật Đất đai sửa đổi sau khi tiếp thu gồm 16 chương, 263 điều, trong đó tăng 5 mục, bổ sung mới 40 điều, bỏ 13 điều so với dự thảo lấy ý kiến nhân dân. TIẾP TỤC QUY ĐỊNH BẢNG GIÁ ĐẤT ĐƯỢC BAN HÀNH HÀNG NĂM Về giá đất, tờ trình dự thảo Luật làm rõ nguyên tắc định giá đất, giá đất thị trường, căn cứ định giá đất, thông tin đầu vào để xác định giá đất, các phương pháp định giá đất; bổ sung quy định về tư vấn thẩm định giá đất. Theo đó, việc định giá đất phải bảo đảm các nguyên tắc phương pháp xác định giá đất theo nguyên tắc thị trường; tuân thủ đúng phương pháp, trình tự, thủ tục định giá đất; bảo đảm khách quan, công khai, minh bạch; bảo đảm tính độc lập trong các khâu xác định giá đất, thẩm định giá đất, quyết định giá đất. Thông tin đầu vào để xác định giá đất theo các phương pháp phải bảo đảm giá đất được ghi trong hợp đồng chuyển nhượng quyền sử dụng đã được công chứng, chứng thực; giá đất trúng đấu giá quyền sử dụng đất mà không chịu tác động của các yếu tố gây tăng hoặc giảm giá đột biến…. Dự thảo Luật tiếp tục quy định bảng giá đất được ban hành hằng năm để bảo đảm giá đất phù hợp với nguyên tắc thị trường. Tuy nhiên, bổ sung quy định về chuyển tiếp thực hiện theo hướng tiếp tục sử dụng bảng giá đất hiện hành đến hết 31/12/2025 để các địa phương có đủ thời gian để xây dựng, ban hành bảng giá đất mới theo quy định mới của Luật Đất đai. Ủy ban nhân dân cấp có thẩm quyền phải phê duyệt quyết định giá đất cụ thể trong thời gian không quá 180 ngày kể từ ngày có quyết định giao đất, cho thuê đất, cho phép chuyển mục đích sử dụng đất, gia hạn sử dụng đất, chuyển hình thức sử dụng đất, điều chỉnh quyết định giao đất, cho thuê đất, điều chỉnh quy hoạch chi tiết. Bên cạnh đó, dự thảo đã sửa đổi quy định các nguồn thu ngân sách từ đất đai; quy định việc tiền thuê đất trả tiền thuê đất hàng năm được ổn định cho chu kỳ 5 năm tính từ thời điểm Nhà nước quyết định cho thuê đất và mức điều chỉnh tăng không quá 15% so với chu kỳ trước đó. Giá đất để tính thuế sử dụng đất phi nông nghiệp được ổn định trong 5 năm. Dự thảo cũng quy định Chủ tịch UBND cấp tỉnh, cấp huyện là Chủ tịch Hội đồng thẩm định giá đất cấp tỉnh, cấp huyện, đồng thời mở rộng thành viên hội động là người có chuyên môn về giá đất. PHÂN CẤP THẨM QUYỀN THU HỒI ĐẤT CHO UBND CẤP HUYỆN VÀ QUY ĐỊNH CÁC TRƯỜNG HỢP THU HỒI ĐẤT Về một số nội dung cụ thể, Bộ trưởng Đặng Quốc Khánh cho biết tiếp thu ý kiến góp ý, dự thảo quy định Nhà nước thu hồi đất để thực hiện các dự án phát triển kinh tế xã hội vì lợi ích quốc gia, công cộng nhằm phát huy nguồn lực đất đai, nâng cao hiệu quả sử dụng đất, phát triển hạ tầng kinh tế xã hội theo hướng hiện đại, thực hiện chính sách an sinh xã hội, bảo vệ môi trường và bảo tồn di sản văn hóa. Đồng thời, quy định cụ thể các trường hợp thu hồi đất đối với các loại công trình công cộng từng lĩnh vực; thu hồi đất để xây dựng trụ sở cơ quan nhà nước, công trình sự nghiệp và một số trường hợp thật cần thiết khác. Dự thảo Luật đã bổ sung quy định phân cấp thẩm quyền thu hồi đất cho UBND cấp huyện không phân biệt người sử dụng đất là tổ chức hay cá nhân, trừ trường hợp thu hồi đất quốc phòng, an ninh. Dự thảo Luật cũng rà soát làm rõ hơn các trường hợp Nhà nước thu hồi đất vì mục đích quốc phòng, an ninh; các trường hợp thu hồi đất do vi phạm để phù hợp với quy định của pháp luật có liên quan như Luật đầu tư, các Luật về thuế, làm rõ hành vi của cơ quan quản lý hoặc của người vi phạm. Dự thảo Luật đã bổ sung quy định phân cấp thẩm quyền thu hồi đất cho UBND cấp huyện không phân biệt người sử dụng đất là tổ chức hay cá nhân, trừ trường hợp thu hồi đất quốc phòng, an ninh. UBND cấp tỉnh quyết định thu hồi đất quốc phòng, an ninh sau khi có văn bản chấp thuận của Bộ trưởng Quốc phòng, Bộ trưởng Công an. Trường hợp không thống nhất ý kiến, UBND cấp tỉnh có trách nhiệm báo cáo Thủ tướng Chính phủ xem xét quyết định. Việc quy định như dự thảo Luật nhằm bảo đảm thống nhất với Luật Quản lý, sử dụng tài sản công; đẩy mạnh phân cấp phân quyền, nâng cao trách nhiệm địa phương, giảm thủ tục hành chính và có cơ chế giải quyết các trường hợp đặc thù khi chưa có sự đồng thuận hoặc có vướng mắc trong tổ chức thực hiện. Về bồi thường, hỗ trợ, tái định cư khi Nhà nước thu hồi đất, Bộ trưởng cho biết, cơ quan soạn thảo đã nghiên cứu, tiếp thu quy định cụ thể, luật hóa một số quy định trong các nghị định hướng dẫn thi hành Luật Đất đai hiện hành đã được thực tế chứng minh là phù hợp đảm bảo quyền và lợi ích hợp pháp của người có đất thu hồi, tạo sự đồng thuận, giảm khiếu kiện; đồng thời tạo điều kiện thuận lợi cho các địa phương trong tổ chức thực thi. Theo đó, việc bồi thường, hỗ trợ, tái định cư khi Nhà nước thu hồi đất phải bảo đảm dân chủ, khách quan, công bằng, công khai, minh bạch, kịp thời và đúng quy định của pháp luật. Người có đất bị thu hồi được bồi thường thiệt hại về đất, tài sản gắn liền với đất, chi phí đầu tư vào đất, thiệt hại do ngừng sản xuất, kinh doanh. Đồng thời được hỗ trợ đào tạo chuyển đổi nghề và tìm kiếm việc làm, hỗ trợ ổn định đời sống, sản xuất, hỗ trợ tái định cư khi Nhà nước thu hồi đất ở; được ưu tiên lựa chọn hình thức bồi thường bằng tiền nếu có nhu cầu được bồi thường bằng tiền. Giá đất bồi thường là giá đất cụ thể của loại đất thu hồi tại thời điểm phê duyệt phương án bồi thường, hỗ trợ, tái định cư. Khu tái định cư phải hoàn thiện các điều kiện về hạ tầng kỹ thuật, hạ tầng xã hội đồng bộ theo quy hoạch chi tiết được cơ quan có thẩm quyền phê duyệt; phải phù hợp với truyền thống văn hóa, phong tục tập quán của cộng đồng dân cư nơi có đất bị thu hồi. Giá đất tái định cư là giá đất cụ thể tại thời điểm phê duyệt phương án bồi thường, hỗ trợ, tái định cư.

Trong trường hợp chủ đầu tư không nộp hồ sơ hoặc không cung cấp, cung cấp không đầy đủ giấy tờ để người mua tự làm thủ tục theo quy định nêu trên sẽ bị phạt tiền và yêu cầu khắc phụ hậu quả tùy theo thời gian và mức độ vi phạm. Mức phạt cao nhất áp dụng đối với thời gian từ 12 tháng trở lên - Phạt từ đến đồng nếu vi phạm dưới 30 căn hộ; - Từ đến đồng nếu vi phạm từ 30 đến dưới 100 căn hộ; - Từ đến 01 tỷ đồng nếu vi phạm từ 100 căn hộ trở lên. The date of conclusion of the violations specified in this Article refers to the date on which all activities included in the violations are finished;g Acts of violating conditions for provision of services regarding land which has been completed according to service agreements or documents signed by relevant parties already satisfying obligations under the agreements or documents; conclusion date of the violations specified in this Point is determined to be the date of signing contract completion records or service provision documents;h Acts of providing inaccurate information serving inspection and/or settlement of disputes regarding land; conclusion date of the violations specified in this Point is determined to be the date on which the provision of inaccurate information for organizations and individuals inspecting and/or settling disputes regarding land is completed as per the law;i Acts of developers of real estate projects failing to submit applications to proceed with procedures for issuance of Certificates for house and construction buyers or lease purchasers, persons receiving the transfer of land use rights or failing to provide or fully provide paper and documents for house or construction buyers or lease purchasers, persons receiving the transfer of land use rights submitting application for issuance of the Certificates by themselves as specified in Clause 7 Article 26 of Law on Housing and Clause 4 Article 13 of Law on Real Estate Trading; despite rectification made by the project developers after the conclusion date. The parties receiving the transfer must adopt measures to rectify remaining consequences with respect to each violation as per the law;b In case of handing over of land use rights without change registration, impose administrative sanctions on both parties handing over land use rights. In case of sale, inheritance, gift or contributed capital in form of land use rights without change registration, impose administrative sanctions on parties receiving the transfer of land use rights. In case of trading land use rights in form of diving plots or selling vacant land in investment projects to build houses for sale as specified in Article 21 of this Decree shall equal the difference between land levy submitted project developers to the State when granted the land with respect to area of land that is divided into plots or sold as vacant land and price of actual transferred land use rights of the project developers according to signed contracts after excluding infrastructure construction expenses if any.6. In case of selling assets attached to land leased by the State for annual rental payment that is ineligible as specified in Article 23 of this Decree, illegal revenues generated by committing violations shall equal depreciation value of assets during the trade period according to value of assets specified in signed trade agreements.
